• New Statutory Framework under the Code of Social Security Act, 2020
The Labour Cess framework has undergone a significant statutory transition with the implementation of the Code of Social Security Act, 2020 and the Code of Social Security Rules, 2026. The revised framework introduces updated provisions governing Labour Cess registration, self-assessment, returns, assessments, refunds, appeals, and compliance procedures.
Effective Dates
- Code of Social Security Act, 2020 – Effective from 21 November 2025
- Code of Social Security Rules, 2026 – Effective from 8 May 2026
Important Transition Note
The transition does not necessarily mean that every earlier project is automatically governed only by the new framework. The applicable legal provisions may depend upon the relevant project period, statutory commencement, saved rights, pending proceedings, and other transitional provisions.
• What Has Changed?
Key Changes Introduced
- Transition to a New Statutory Framework
The earlier BOCW Welfare Cess Act, 1996 and Welfare Cess Rules, 1998 have been replaced by the Code of Social Security Act, 2020 and the Code of Social Security Rules, 2026, establishing a revised legal framework for Labour Cess administration. - Self-Assessment Introduced
Employers are now required to determine and report Labour Cess liability through a structured self-assessment process supported by prescribed documentation and statutory records. - New Statutory Forms
The revised Rules prescribe new forms for registration, self-assessment, project modifications, completion, and appeals, replacing the earlier procedural framework. - Revised Assessment Process
The assessment process has been reorganized with clearer procedures covering scrutiny, determination of cess liability, refund claims, and appeals under the new Rules. - Greater Role of Technical Certification
The revised framework places greater reliance on Chartered Engineer certification for determining construction cost during self-assessment and final assessment. - Structured Refund & Appeal Mechanism
The new Rules provide a more clearly defined framework for refund applications, recovery proceedings, and appeals before the prescribed authority.
• Chartered Engineer Certification
Greater Role of Chartered Engineer Certification
The revised framework places increased emphasis on technical certification of construction cost through a Chartered Engineer during the self-assessment and final assessment process. Proper technical certification helps support the determination of assessable construction cost under the statutory framework.
